Booking Terms & Conditions
Tom Barker Group Pty Ltd.
Applies to all 47A® and Expedition Ice events.
- Definitions
- Company: Tom Barker Group Pty Ltd (ACN 628 158 832).
- Guest / Ticket Holder: The individual purchasing and/or attending the Event.
- Event: Any 47A® or Expedition Ice experience hosted by the Company.
- Venue: The location where the Event is held, as stated in the booking confirmation.
- Ticket Price: The price per person as stated in the event booking form or invoice.
- Event Credit: A non-cash credit equal to amounts paid by the Guest, redeemable against any future Tom Barker Group event within 24 months of the scheduled Event date.
- Force Majeure: Any event beyond the reasonable control of the Company, including but not limited to adverse weather, government restrictions, pandemics, industrial action, acts of terrorism, or venue closures.
- Inclusions
- Exclusive private hospitality venue or lodge with premium views or access.
- Curated premium catering and beverage service.
- Entertainment, displays and curated experiences relevant to the Event.
- Professional hosting and guest services.
- Booking & Payment
- Bookings are confirmed only upon receipt of full payment in cleared funds, or upon signed agreement where one applies.
- Payment must be made to the Company’s nominated bank account or via approved payment link.
- The Guest is responsible for all bank charges and currency conversion fees.
- Payment Default & Non-Attendance
- If full payment is not received by the due date specified on the invoice, the booking will be automatically cancelled and any deposit forfeited.
- If a Guest fails to attend the Event for any reason, no compensation, replacement or refund will be provided.
- Non-Refundable Policy
- All tickets and payments are strictly non-refundable once payment has been received, in all circumstances, including illness, travel disruption, change in personal circumstances or inability to attend.
- No cash refunds are provided under any circumstances. Where an Event is cancelled, section 11 applies.
- Tickets are transferable only with prior written consent from the Company and may be subject to Venue or regulatory restrictions.
- Transfer & Resale Rules
- Tickets may not be resold for a price greater than the original purchase price.
- Transfers are permitted only to individuals meeting all eligibility and ID requirements of the Company and the Venue.
- The Company may refuse any transfer inconsistent with the private nature of the Event, at its sole discretion.
- Venue & Access Conditions
- Venue security reserves the right to search bags and personal belongings.
- Access may be refused for safety, security or operational reasons without refund.
- The ticket does not include parking unless expressly stated in writing.
- Dress Code & Behaviour
- Guests are required to wear attire appropriate to the Event, as specified on the relevant event page.
- Guests are expected to conduct themselves in a manner consistent with the private and premium nature of the 47A® environment.
- The Company and Venue operators reserve the right to refuse entry or remove any Guest whose attire or conduct is unsafe, disruptive or inconsistent with event standards, without refund.
- Event Timing Disclaimer
- Event schedules are set by the official organiser and may change without notice.
- Hospitality access times are fixed and will not be extended due to schedule delays.
- The Company accepts no liability for changes to race or activity timing.
- Legal Compliance & Safety
- Guests must comply with all safety rules, health regulations and security instructions issued by the Company, Venue staff or officials. Any Guest who fails to comply may be removed from the Event without refund.
- Event Changes & Force Majeure
- The Company may make reasonable amendments to hospitality programming, entertainment, culinary partners, suite configuration and operational delivery without liability.
- Should an Event be fully cancelled by the official promoter, a relevant government authority or the Company, the Guest will receive a non-cash Event Credit equal to amounts paid, redeemable against any future Tom Barker Group event within 24 months of the scheduled Event date. Event Credits are not redeemable for cash, in whole or in part.
- If an Event is postponed, tickets remain valid for the rescheduled Event.
- Ancillary Costs
- Unless expressly stated, the Hospitality Package does not include flights, accommodation, visas, travel insurance or personal expenses.
- Liability & Indemnity
- To the fullest extent permitted by law, the Company’s liability is limited to the total amount paid by the Guest. The Company is not liable for indirect, consequential, incidental or economic loss, including travel costs, accommodation costs, business interruption, loss of enjoyment or loss of opportunity. The Guest indemnifies the Company, its employees and contractors against all claims arising from the Guest’s acts, omissions or breach of these Terms & Conditions.
- Insurance
- The Company strongly recommends that the Guest obtain comprehensive travel, medical and event disruption insurance covering personal injury, illness, travel delays and inability to attend.
- Photography & Media
- Photography, videography and content capture will occur throughout the Event. By attending, the Guest grants the Company the right to use captured content, including their likeness, for editorial, promotional and commercial purposes without further consent or payment.
- Governing Law
- These Terms & Conditions are governed by the laws of Queensland, Australia, and the Parties submit to the exclusive jurisdiction of its courts.
- Acceptance of Terms
- By booking, the Guest confirms they have read and understood these Terms & Conditions, agree to be bound by them in full, and understand that all bookings are final, tickets are strictly non-refundable, and any cancellation remedy is limited to the Event Credit described in section 11.
- Event Specific Terms
- Each Event may carry additional event specific terms, published on the relevant event page and forming part of these Terms & Conditions. Where event specific terms conflict with this document, the event specific terms prevail for that Event.
