Applies to all 47A® Private Hospitality and Expedition Ice events

  1. Definitions
    1. Company: Tom Barker Group Pty Ltd (ACN 628 158 832).
    2. Guest / Ticket Holder: The individual purchasing and/or attending the Event.
    3. Event: Any 47A® Private Hospitality or Expedition Ice experience hosted by the Company.
    4. Venue: The location where the Event is held, as stated in the booking confirmation.
    5. Ticket Price: The price per person as stated in the event booking form or invoice.
    6. Force Majeure: Any event beyond the reasonable control of the Company, including but not limited to adverse weather, government restrictions, pandemics, industrial action, acts of terrorism, or venue closures.
  2. Inclusions
    • Exclusive private hospitality venue or lodge with premium views or access.
    • Curated premium catering and beverage service.
    • Entertainment, displays, and curated experiences relevant to the Event.
    • Professional hosting and guest services.
  3. Booking & Payment
    • Bookings are confirmed only upon receipt of full payment in cleared funds.
    • Payment must be made to the Company’s nominated bank account or via approved payment link.
    • The Guest is responsible for all bank charges or currency conversion fees.
  4. Payment Default & Non-Attendance
    • If full payment is not received by the due date specified on the invoice, the booking will be automatically cancelled and any deposit forfeited.
    • If a Guest fails to attend the Event for any reason, no compensation, replacement, or refund will be provided.
  5. Non-Refundable Policy
    • All tickets are 100% non-refundable once payment has been received.
    • This applies in all circumstances, including but not limited to illness, travel disruption, change in personal circumstances, or inability to attend.
    • Tickets are transferable only with prior written consent from the Company and may be subject to Venue or regulatory restrictions.
  6. Transfer & Resale Rules
    • Tickets may not be resold for a price greater than the original purchase price.
    • Transfers are permitted only to individuals meeting all eligibility and ID requirements of the Company and the Venue.
    • The Company reserves the right to refuse any transfer request at its sole discretion.
  7. Venue & Access Conditions
    • Venue security reserves the right to search bags and personal belongings.
    • Access may be refused for safety, security, or operational reasons without refund.
    • The ticket does not include parking unless expressly stated in writing.
  8. Dress Code & Behaviour
    • Guests are required to wear attire appropriate to the Event (e.g., smart casual, cocktail, or as otherwise specified).
    • Offensive clothing or behaviour will not be tolerated.
    • The Company reserves the right to refuse entry or remove any Guest based on attire or conduct, without refund.
  9. Event Timing Disclaimer
    • Event schedules are set by the organiser and may change without notice.
    • Hospitality access times are fixed and will not be extended due to schedule delays.
    • The Company accepts no liability for changes to race or activity timing.
  10. Legal Compliance & Safety
    • Guests must comply with all safety rules, health regulations, and security instructions issued by the Company, Venue staff, or officials.
    • Any Guest who fails to comply may be removed from the Event without refund.
  11. Event Changes & Force Majeure
    • The Company may alter the Event schedule, inclusions, or entertainment without liability.
    • If the Event is cancelled, postponed, or materially changed due to Force Majeure, no refunds will be provided.
    • The Company will use reasonable efforts to provide an alternative hospitality or experience where feasible.
  12. Ancillary Costs
    • Unless expressly stated, the Hospitality Package does not include flights, accommodation, visas, travel insurance, or personal expenses.
  13. Liability & Indemnity
    • To the fullest extent permitted by law, the Company’s liability is limited to the amount paid for the Hospitality Package.
    • The Company is not liable for any indirect, special, or consequential losses, including loss of enjoyment, opportunity, or additional travel/accommodation expenses.
    • The Guest indemnifies the Company, its employees, and contractors against all claims arising from the Guest’s acts, omissions, or breach of these Terms & Conditions.
  14. Insurance
    • The Company strongly recommends that the Guest obtain comprehensive travel and event insurance covering personal injury, illness, travel delays, and inability to attend.
  15. Photography & Media
    • The Guest acknowledges that photography and videography may take place at the Event.
    • By attending, the Guest grants the Company the right to use their likeness in marketing and promotional materials without further consent or payment.
  16. Governing Law
    • These Terms & Conditions are governed by the laws of Queensland, Australia (or the Event’s host country, at the Company’s election), and the Parties submit to the exclusive jurisdiction of its courts.
  17. Acceptance of Terms
    • Have read and understood these Terms & Conditions.
    • Agree to be bound by them in full.
    • Understand that all bookings are final and tickets are strictly non-refundable.
